HPD Violations
Housing Preservation and Development
NYC Housing Preservation and Development (HPD) is the nation's largest municipal housing agency, responsible for enforcing the NYC Housing Maintenance Code. HPD issues violations when landlords fail to maintain safe and habitable conditions for tenants, covering everything from heat and hot water to pest infestations and lead paint.
Overview
HPD violations are categorized into three classes: Class A (non-hazardous, 90 days to correct), Class B (hazardous, 30 days to correct), and Class C (immediately hazardous, 24 hours to correct). Class C violations include lack of heat, no hot water, lead paint hazards, and pest infestations. HPD can place violations on your building's record, and unresolved violations can trigger Emergency Repair Program (ERP) charges.
Common HPD Violations
- Failure to provide heat (Oct 1 - May 31)
- Failure to provide hot water
- Lead paint hazards (children under 6)
- Pest and vermin infestations
- Peeling paint and plaster in disrepair
- Broken or defective plumbing
- Inadequate fire escapes or exits
- Window guard violations
